Section 48
To be punished with imprisonment
(1) An armed forest guard who commits the following offense shall be punished with imprisonment for life: 0
(a) In the event of a total rebellion,
(b) any act, written, spoken or by sign or in any other manner, which may cause hatred, malice or contempt to disturb the sovereignty, geographical integrity, nationality and independence of Nepal or the federal unit or the good relations between different castes, castes, religions and sects; If done,
(c) In case of selling or in any way handing over to someone else the weapons or goods of the government or anyone under his charge,
(d) if he absconds with arms and ammunition which he has kept for his own use or which he has taken charge of,
(e) directly or indirectly aiding terrorist activities,
(f) Providing or attempting to provide information and news related to security to unauthorized persons, organizations or groups or encouraging others to do so.
(2) An armed forest guard who commits any of the following offenses shall be punished with imprisonment from two years to twelve years depending on the amount of the offence:-
(a) using criminal force or attempting to do so after knowing or having reasonable grounds to know that he is an armed forest guard of a higher rank or any other officer having authority related to security, regardless of whether he is in deputation or not,
(b) If, knowing that he is plotting or undertaking an armed rebellion, he does not inform his superiors as soon as possible. (c) If any kind of assistance is given to the perpetrators of forest breeding, poaching of wild animals or connivance of forest-related offences,
(d) If he knowingly allows or assists the accused to escape under his charge or control.
(3) An armed forest guard who commits the following offenses shall be punished with imprisonment for a term which may extend to two years depending on the amount of the offence:-
(a) Intoxicated while on duty or disobeys the orders of his commander or leaves the camp without permission,
(b) taking membership of any political organization or party or politicalIf participating in purposefully organized processions or demonstrations,
(c) if he misappropriates, negligently loses, defaces or destroys arms, articles or vehicles or cash or goods in his charge,
(d) Absconding with property in his charge.
(4) If an armed forest guard in any way loots government or public or personal property or causes loss, he shall be punished with imprisonment for an additional two years in accordance with the prevailing law.
